Terms of Service
Draft for attorney review. This document was prepared as a starting point and has not yet been reviewed by a lawyer. It will be finalized before ailandlord accepts its first landlord. Questions: hello@ailandlord.io.
These terms govern your use of ailandlord.io and the ailandlord application ("the Service"), provided by ailandlord ("we," "us"). By creating an account or using the Service, you agree to them.
1. What ailandlord is — and isn't
ailandlord is software that helps landlords list units, screen applicants, execute leases, collect rent, track maintenance, and keep books, with an AI that performs routine actions and prepares decisions for your approval.
ailandlord is in private beta and is not generally available. The features and fees described below describe the Service as it is being built; they take effect for you when we agree terms with you directly and you begin using the Service. ailandlord is not a property manager, a law firm, a credit bureau, or a bank. We do not manage your property, give legal advice, make tenancy decisions, or hold your funds. You remain the landlord of record, responsible for complying with all federal, state, and local landlord-tenant, fair housing, and consumer protection laws.
2. Eligibility and accounts
- You must be 18 or older and legally able to enter contracts.
- You are responsible for your account credentials and everything done under your account.
- You must provide accurate information about yourself and your properties.
3. The AI and your responsibility
The Service uses AI to take actions within the rules you configure — for example, sending a late-payment reminder on the schedule you set, applying the late fee you chose, or categorizing an expense. You agree that:
- You are responsible for the rules you set. If you configure a late fee that exceeds what your state allows, that is your responsibility, not ours.
- AI-generated content (listing copy, screening summaries, notices) can contain errors. You are responsible for reviewing anything sent on your behalf that has legal effect.
- Every action is logged and most are reversible from your ledger. You agree to review your ledger regularly.
- The Service never approves or denies an applicant. Tenant selection is your decision, and you are responsible for making it in compliance with fair housing law.
4. Tenant screening
Screening reports will be provided by a licensed consumer reporting agency and are subject to the Fair Credit Reporting Act (FCRA). By requesting a report you certify that you have a permissible purpose (evaluating a rental application), will use the report only for that purpose, will not share it, and will send the required adverse-action notice if you deny an applicant based in whole or part on the report. The Service generates that notice for you; sending it is your responsibility.
5. Payments
- Rent payments will be processed by a licensed payment processor under that processor's terms. ailandlord does not hold, custody, or take ownership of tenant funds at any point.
- Payout timing depends on the processor and your bank, typically 1–3 business days for ACH.
- Failed or reversed payments are the tenant's obligation to you; we will notify you and retry per your settings, but we do not guarantee collection.
6. Fees
- Landlord subscription: $4 per unit per month, billed monthly. Your first unit is free permanently. Founding landlords who join during the private beta keep their rate for as long as their account is continuously active.
- Tenant screening: $35, paid by the applicant.
- ACH rent collection: a flat $2 per payment, paid by the tenant.
- No setup fee. Cancel anytime; you will not be billed for the following month.
We may change fees for new customers at any time and for existing customers with 30 days' notice, except where a founding-landlord rate applies.
7. Leases and documents
Lease templates are drafted for the states we support and reviewed for general compliance, but laws change and local ordinances vary. Templates are provided as a starting point, not legal advice. You are responsible for confirming a lease is appropriate for your property and jurisdiction before signing. E-signatures will be provided by a third-party e-signature provider and are legally binding under the ESIGN Act.
8. Acceptable use
You may not use the Service to discriminate against any applicant or tenant on a basis protected by federal, state, or local law; to harass tenants; to collect fees you are not legally entitled to; to screen people for any purpose other than a rental application; or to interfere with the Service's security or operation.
9. Your data
You own your property and tenant data. We use it only to provide the Service as described in our Privacy Policy. You can export it at any time. You are responsible for having the right to enter tenant and applicant data into the Service.
10. Availability and changes
We aim for the Service to be available continuously but do not guarantee uninterrupted access. We may add, change, or remove features. Where a change materially reduces functionality you are paying for, we will give you notice and the option to cancel.
11. Disclaimers
The Service is provided "as is." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including fitness for a particular purpose. We do not warrant that AI-generated content is accurate, that any applicant will pay rent, or that any lease is enforceable in your jurisdiction.
12. Limitation of liability
To the fullest extent permitted by law, ailandlord's total liability to you for any claim arising from the Service is limited to the fees you paid us in the 12 months before the claim. We are not liable for indirect, incidental, or consequential damages, including lost rent, lost tenants, or legal costs arising from your use of the Service or from decisions you made using it.
13. Indemnification
You agree to indemnify ailandlord against claims arising from your violation of these terms or of any law, including fair housing and FCRA obligations, in your use of the Service.
14. Termination
You may cancel at any time. We may suspend or terminate accounts that violate these terms, with notice where practical. On termination, you may export your data for 30 days, after which we may delete it subject to legal retention requirements.
15. Governing law and disputes
These terms are governed by the laws of the State of Colorado. Disputes will be resolved in the state or federal courts located in Colorado, and you consent to their jurisdiction.
16. Changes to these terms
We will post updates here and notify account holders by email of material changes at least 30 days before they take effect.
